           Some residents have inquired about reserving the Park on certain days for large family gatherings or other events.  The answer is “yes”, except for the following days:

 

          Easter

          Fourth of July

          Annual City Picnic

Minutes                                              January 11, 2007

 

The regular meeting of the City Commission was called to order at 7:30 PM on January 11, 2007 at the meeting room of the Hurstbourne Acres City Hall/Police Department, 1940 S. Hurstbourne Parkway, Louisville, Kentucky, with the following persons present:

December 14, 2006 Minutes

Commissioner Hardin made a motion to approve as published.  The motion was seconded by Commissioner Nichols and passed unopposed.  It was noted by Attorney Emery that the minutes should first be approved by the Commission before publication.

 

Treasurer’s Report/Warrants

            John Price read the treasurer’s report for December, 2006 and copies were made available for all people in attendance.  Commissioner Hardin then made a motion to approve as read, which was seconded by Commissioner Lynch.  The motion passed without opposition.

            The warrants for December, 2006 were then read by John Price, and copies were made available for all people in attendance.  Commissioner Hardin made a motion to approve payment of the warrants, which was seconded by Commissioner Nichols and passed without opposition. 

 

Attorney’s Report

            In answer to the question about the amount of land available near the berm that runs from northeast of old Hurstbourne Lane to along the tract of land where the white pines are located, was reported by Attorney Emery to be 25 ft from the rear of the houses. 

            In other news, it was noted by the attorney’s office that in the 5-year examination of the city ordinances, it was found that the ordinances regulating the construction of fences and garages may be subject to legal challenge.  The regulation of those types of structures is now controlled by the Metro government.  After discussion by the Commission, it was agreed to leave the ordinances on the books as is.

            Attorney Emery has been in contact with the person contracted by El Toro to construct a sign advertising the restaurant.  He advised them that there are restrictions and must make application to Planning & Design Department.  Finally, it was discovered that there are several references to landscaping in the original plans for Camden Apartments, but they are currently being archived.  Those plans have been ordered, and will be reviewed by the attorney’s office when received.

 

MRI Trailer

            Concerning the situation about the MRI trailer, Mayor Fore has received a letter from Hagan Properties which was read in the meeting.  In response, Mayor Fore sent a letter to Hagan Properties which was also read in the meeting.  Because there has been no reply as of today, Mayor Fore has instructed the attorney’s office to initiate a lawsuit against Hagan Properties to resolve the issue.

 

Statements of Financial Interests

            As required by law, the statements of financial interests have been distributed to all elected city officials for completion.  The completed statements will be held by Sally Price, publisher of the city newsletter.

 

Police Chief

            Mayor Fore advised that Police Chief Redman had to go to the hospital, so no report was available at this time of the meeting.

 

COMMITTEE REPORTS

 

Parks

            New Parks Commissioner Brent Hardin had nothing specific about which to report.

 

Sanitation

            New Commissioner Jim Lynch had nothing specific about which to report.

 

Roads

            Commissioner Nichols advised that she received a complaint from a resident who thought that another resident on Hurstbourne Lane might be using his garage in a car repair business.   A resident at the meeting was able to confirm that the resident in question only works on his own cars.  She also reported that 3 sections of the log fence by the Camden Apartments are down and need repair.  Mayor Fore said that he would contact the manager of the apartments.  Finally, it was mentioned that all of the street lights have now been fixed.

 

OLD BUSINESS

 

Cleanout Behind Hurstbourne Circle

            Commissioner Lynch contacted several people about the cost to cleanup/cleanout behind some of the homes on Hurstbourne Circle.  He received four bids that ranged from $7500 to $3500.  After discussion, Commissioner Nichols made a motion to accept the bid from ‘Kentucky Tree Company’ for $3500 subject to a certificate of insurance indicating a liability limit of at least $2 million.  The motion was seconded by Commissioner Hardin and passed unopposed.

 

Police Chief’s Return to Work

            Mayor Fore instructed Police Chief Redman to obtain a medical release from the doctor authorizing his return to work.

 

Fire Lane on Hurstbourne Circle

            The attorney’s office has confirmed that the 1991 ordinance requiring a fire lane on Hurstbourne Circle exempted the first two houses on the north & south entrances to the street.  Mayor Fore tabled the discussion until next month’s meeting, allowing Commissioner Lynch to do further research.

 

‘No Right Turn on Red’ Sign at Bunsen Way/Speed Humps

            The attorney’s office, in their review, learned that the land on which the sign would be erected is under the authority of the Commonwealth of Kentucky.  However, they are undertaking a study that will include accident information for the past three years and will report back to our attorney.

            Concerning speed humps, Attorney Emery was asked to review and counsel the Commission at next month’s meeting.

 

Police Report

            With Police Chief Redman now in attendance, the police report was provided to Mayor Fore who read the following:

            -132 coverage hours from 12/15/06 to 1/11/07,

            -98 police & public contacts,

            -7 traffic stops, 3 citations,

            -5 reports (1 theft, 1 burglary, 1 attempted theft, 1 dog bite, & 1 criminal mischief),

            -4 motorists assists,

            -3 suspicious persons questioned,

            -Phone plan to be changed to ‘Cricket’

            -Mileage on the police car is now 4,190 miles.

 

Ordinance Retaining the City Attorney

            Commissioner Nichols made a motion to have the first reading of Ordinance #1, Series 2007, retaining the city attorney.  The motion was seconded by Commissioner Lynch and passed unopposed.  The 1st reading was then completed by Mayor Fore.

 

Miscellaneous

            Issues brought up by residents at the meeting included the need for police coverage hours at night, early dumpster pickups (Police Chief Redman will check, and Mayor Fore will follow-up with a letter to the companies in question), and an inquiry about whether the city is considering hiring another police officer again.

 

There being no further business or discussion, the meeting was adjourned.
