Minutes                                                            May 10, 2007

The regular meeting of the City Commission was called to order at 7:30 PM on May 10, 2007 at the meeting room of the Hurstbourne Acres City Hall/Police Department, 1940 S Hurstbourne Parkway, Louisville, Kentucky, with the following persons present:

April 12, 2007 Minutes

A special meeting was held on April 19, 2007 at 7:30 pm to approve the minutes as corrected. In attendance were Mayor Fore, Commissioners Dunn, Hardin, Lynch & Nichols.  Commissioner Dunn made a motion to approve as read.  The motion was seconded by Commissioner Nichols.  With three in favor and one opposed (Commissioner Hardin), the motion carried.

 Treasurer’s Report

                John Price read the treasurer’s report for April, 2007 and copies were made available for all people in attendance.  Commissioner Dunn then made a motion to approve as read, which was seconded by Commissioner Nichols.  The motion passed without opposition.

 

Warrants

                The warrants for April, 2007 were then read by John Price, and copies were made available for all people in attendance.  Commissioner Dunn made a motion to approve payment of the warrants, which was seconded by Commissioner Nichols and passed without opposition. 

 

Police Report

                Police Chief Redman reported the following:

                -189 coverage hours from 4/13/07 to 5/10/07,

                -112 police & public contacts,

                -No arrests, citations or reports,

                -7 traffic stops,

                -6 suspicious person complaints,

                -Speed hump survey was completed for Blowing Tree

                -Stalker complaint at Camden Apartments,

                -Mileage on the police car is now 6,289 miles.

 

Attorney’s Report

                Ashley Flynn was in attendance as a representative from the Attorney’s Office, but there was no specific report.

 

COMMITTEE REPORTS

Police Commissioner

                Commissioner Dunn reported that the city received a ‘Thank You’ note for flowers the city sent to a resident whose husband recently passed away.  In other news, Commissioner Dunn & Police Chief Redman completed a survey of residents on Blowing Tree Rd concerning installation of a ‘speed hump’.  Of the 7 residences, 5 were in favor and the other 2 did not respond.  As it relates to the situation on Blowing Treed Rd, Commissioner Dunn also shared information about the Hurstbourne Area Traffic Studies designed to alleviate traffic congestion on Hurstbourne Parkway.  A resident at the meeting suggested that speed humps would be helpful on other streets in the city as well.  Another resident pointed out that speed humps can slow the response time of emergency vehicles.  Concerning a question about why the police vehicle had only been moved into the main subdivision for a short time as a deterrent, Police Chief Redman advised that there had been criminal mischief to the vehicle.  Other methods for controlling speeders in the city were discussed.  Commissioner Dunn continues to work on the total hours and schedule for the Police Chief to maximize the benefit to the city.  Finally, an incident that occurred at 5:30 pm today, a large sinkhole at the corner of Woodfield & Haviland developed creating a potential hazard to the residents.  MSD responded within 30 minutes of being contacted, and has temporarily secured the hole.

 

Sanitation Commissioner

                Commissioner Lynch advised that a new recycling bin had been delivered to a resident on Wesley. There was also a missed garbage pickup on Woodfield.  An issue about grass clippings at a residence on Woodfield has been resolved.  A resident called Commissioner Lynch about adding additional garbage cans in the park.  This suggestion was passed on to Parks Commissioner Hardin, who said he would handle.  There has been another complaint about early morning dumpster pickup.  Police Chief Redman has already contacted the waste deposal company responsible, and Commissioner Lynch talked personally to the driver to resolve this problem.   

 

Parks

                Commissioner Hardin advised that ‘StumpBusters’ is getting the grass cut in the park and retention basin. However, there was a complaint from a resident on Hurstbourne Circle that an area above the retention basin that is not on an easement was being missed.  Commissioner Hardin has contacted ‘Stumpbusters’ to correct.  Concerning the area in the ditch by the carwash, the city has said it would pay extra to have trash cleared out so that it can be cut.  Mayor Fore offered to contact the state to get their help in getting the ditch cleared of trash.

                In other news, regarding the repair of the picnic tables, 2 residents along with Commissioner Hardin were able to drill holes and insert additional bolts in each picnic table.  The tables were also sanded and weather-sealed.  It was also mentioned that some dead trees in the park will need to be removed at some point.  A resident called Commissioner Hardin & Mayor Fore to have additional flowers planted at the entrance to the park.  In answer to a suggestion about having a port-a-let at the park, Commissioner Hardin has contacted several companies.  ‘Moon Portable Restrooms’ quoted a price of about $30/week, including tax, for which they will, on a weekly basis, clean, spray and/or sanitize.  The port-a-let would be in the park from May until the end of September.  Commissioner Hardin was instructed to contact the company again to verify the contract requirements for the city, and if acceptable, proceed with the installation on a trial basis.

                Finally, additional information and details were provided on the final, proposed walking path in the city.  After a long discussion, Commissioner Hardin made a motion to have the walking path built as presented for a cost not to exceed $56,000.  The motion was seconded by Commissioner Nichols, and after strong opposition by Mayor Fore, passed unopposed by the commissioners.  It was noted that the contract to build will have to be bid.  Because of concerns about the walking path by residents on Addington, Commissioner Hardin agreed to contact each resident about the specific plans.

 

Roads Commissioner

                 Commissioner Nichols discussed the informal bids to have the city streets repaved.  The bids ranged from $106,806 to $256,000.  Commissioner Nichols recommended the bid from ‘Flynn Brothers’.  The repaving contract still needs to be formally published for bid.

               

OLD BUSINESS

2nd Reading of Ad Valorem Tax Ordinance

                Commissioner Dunn made a motion to have the second reading of Ordinance #2, Series 2007, establishing the Ad Valorem Tax Rate for the fiscal year from 7/1/07 to 6/30/08.  The motion was seconded by Commissioner Nichols, which passed unopposed.  The second reading was then completed by Mayor Fore.  Commissioner Dunn then made a motion to enact and ordain, which was seconded by Commissioner Hardin, and passed unopposed.

 

2nd Reading of Budget Ordinance

                Commissioner Dunn made a motion to have the second reading of Ordinance #3, Series 2007 establishing the budget for the next fiscal year.  It was noted that the first reading was completed at the special meeting held on 4/19/07.  The motion was seconded by Commissioner Hardin, and passed without opposition.  After Mayor Fore completed the second reading, including an adjustment for the walking path, Commissioner Dunn made a motion to enact and ordain.  This motion was seconded by Commissioner Hardin, and passed unopposed.

 

Miscellaneous

                Mayor Fore reminded everyone of the new polling location, the cafeteria at the Kennedy School.  The city’s website is now back up and running.  Mayor Fore has asked Commissioner Nichols to contact ‘Stumpbusters’ about the late invoicing.  Finally, Commissioner Lynch suggested that the money from a CD that is coming due in July be given to the property owners as a tax refund.  It would reflect 25% of the tax burden for each property owner for this coming year.  Before any further consideration is given, Mayor Fore has requested a legal opinion from the Attorney’s office. 

 

There being no further business or discussion, the meeting was adjourned.
