FREE MULCH:

Several loads of small-size tree mulch was dumped in the Bunsen berm area close to Hurstbuonre Parkway.  This came from fallen limbs and trees in Welch Park and the berm areas.  It’s good for acid-loving plants and landscaping needs.  Free to residents.  Bring you containers and shovels.

Minutes                                     September 11, 2008

 

The regular meeting of the City Commission was called to order at 7:30 pm on September 11, 2008 at the meeting room of the Hurstbourne Acres City Hall/Police Department, 1940 S. Hurstbourne Parkway, Louisville, Kentucky, with the following persons present:

Minutes for Meeting on August 14, 2008

Commissioner Dunn made a motion to accept the minutes as read.  The motion was seconded by Commissioner Hardin and passed with one opposed, Commissioner Nichols.

 

Treasurer’s Report

John Price read the treasurer’s report for August, 2008 and copies were made available for all people in attendance.  Commissioner Dunn then made a motion to approve as read, which was seconded by Commissioner Nichols.  The motion passed unanimously.

 

Warrants

The warrants for August, 2008 were then read by John Price, and copies were made available for all people in attendance.  Commissioner Dunn made a motion to approve payment of the warrants, which was seconded by Commissioner Hardin and passed unopposed. 

 

Police Report

Police Commissioner Dunn read the following report:

            -Officer Yocum has been promoted to Lieutenant and is no longer an employee of Hurstbourne Acres but is contracted under the same rate and conditions as before. 

            -280 police hours from 8/14/08 to 9/11/08,

            -310 police/public contacts,

            -3 citations, 4 arrests,

            -2 robberies,

            -3 theft reports,

            -2 accidents,

            -19 suspicious persons,

            -4 motorist assists,

            -Block Watch program continues,

            -Theft of signs reported,

            -Mileage on the police car is at 16,478 miles,

                       

Other issues mentioned were an abandoned car on Hurstbourne Circle, 1-way violators on Hurstbourne Lane, and a pending reply from Attorney Emery regarding the house on Cardwell Way.

 

Attorney’s Report

In the absence of an attorney this meeting, there was no report.

 

COMMITTEE REPORTS

Sanitation Commissioner

Commissioner Lynch reported several misses on Cardwell way as well as the garbage cans in the park.  Rumpke was contacted and this has been resolved.

 

Parks Commissioner

Commissioner Hardin reported that a flag has been installed, but a volunteer is needed to be the ‘Keeper of the Flag’.  In other news, the park has been cleaned up for the upcoming picnic, there is a new plaque on the building in the park, a new water pump has been installed including a faucet.  There was a discussion regarding installing a lock for the faucet.  Concerning the city picnic, all of the preparations have been completed, including the honor guard, fire truck, food, drinks, inflatables, door prizes, etc.

 

Roads Commissioner

Commissioner Nichols discussed the ‘Geese’ problem in the city, particularly around the park.  After outlining the options, including the methods used to remove the geese, she recommended that the Kentucky Fish & Wildlife Department be contracted to relocate the geese.  Commissioner Dunn made a motion to contract with the Kentucky Fish & Wildlife as indicated for an amount of $800.  The motion was seconded by Commissioner Nichols, and passed without opposition.

 

After Commissioner Nichols reported on her efforts in obtaining a vendor for leaf and snow removal, Mayor Fore decided to reassign those duties to Commissioner Dunn.

 

OLD BUSINESS

Investment Ordinance

Mayor Fore and Commissioner Dunn met with the city’s investment advisor.  The advisor proposed some changes to the current investment ordinance.  The intention is to incorporate the approved changes to the ordinance and have the first reading at the November meeting and the second reading at the December meeting in preparation for the upcoming year.

 

Galapaloosa

After a detailed discussion of the cost to remove the horse from its current location, repair and install the horse at the park, including the city’s liability, Commissioner Hardin made a motion to drop the issue and decline the gift of the Galapaloosa horse to the city.  Commissioner Nichols seconded the motion, which passed unopposed.

 

 

 

 

NEW BUSINESS

Candidate Debate

Mayor Fore confirmed that there are 8 candidates running for 4 positions on the Commission.  Two residents of the city suggested that the city hold a ‘debate’ to discuss the issues important to our city.  After listening to several comments from those in attendance, Mayor Fore said that he would report at next month’s meeting.

 

Fence Permit/Rental Property Conditions

Mayor Fore reviewed a fence permit request from an owner of a property on Cardwell Way, Bruce Collier, which has been approved.  Mr. Collier, who was in attendance, did dispute the comments published in the July minutes stating that discretionary funds from Julie Raque Adams were used to pay for the resodding of the property.  There was also further discussion of the costs and benefits of to the city for taxing or restricting rental property.

 

Record Retention Guidelines

Mayor Fore briefly discussed the record retention requirements for a city and indicated that he would have a full report at next month’s meeting.

 

Presentation by Jon Ackerson

City Metro Candidate, Jon Ackerson, expressed his ideas and opportunities for representing this district on the Louisville Metro Council.

 

Skunk Patrol

It was reported that the city has already spent $843 for the capture and removal of skunks in the city, including setting 14 traps, all without success.  The city’s efforts will continue.

Police Commissioner Dunn read the following report:

Starting the week of 10/20, Police Commissioner Dunn along with Police Chief Redman will be walking around the city with Block Watch captains discussing crime issues. 

 

Attorney’s Report

Attorney Steve Emery had nothing specific about which to report.

 

COMMITTEE REPORTS

Parks Commissioner

Commissioner Hardin reported that trees damaged in the wind storm on 9/14/08 will be removed.  The city also agreed to pay for the removal of the debris from the storm.  That will be completed within the next 7 to 10 days.  In other news, it was noted that the Port-A-Let in the park will be removed at the end of the month.  There were many compliments about the success of the city picnic.  10 residents, who were not able to make it to the picnic, were taken food that day.  In answer to a question about the availability of food for those who are  diabetic, Commissioner Hardin advised that he would make sure that next year’s picnic would take that into consideration.  Finally, it was mentioned that American Legion Post #244 donated $100 to help offset the cost of the flag in the park.

 

Police Commissioner

Commissioner Dunn introduced the first person to serve as Police Chief for the City of Hurstbourne Acres, Denny Comer.   The upcoming Leaf Removal dates were discussed; first pickup is scheduled for 10/26, 10/27, & 10/28, second scheduled pickup is 11/16, 11/17, & 11/18, and the final pickup will be 12/7, 12/8, & 12/9.  Leaves should be raked to within 3 ft. of the street, and in case of inclement weather, will be picked up the day after.

 

Concerning the snow removal contract, Commissioner Dunn mentioned the problem with people parking on the street, hindering the snow removal efforts.  To resolve this issue, it was recommended that the city pass a ‘Snow Emergency’ ordinance which the attorney’s office will develop and furnish to the Commissioner for review.

 

Roads Commissioner

As discussed earlier, Commissioner Nichols will contact the Kentucky Fish & Wildlife Department to proceed with the removal of the geese.  It was mentioned that the new signs at Blowing Tree & Bristol were up but the one on Blowing Tree has already been stolen.  Two more signs have been ordered.  To refute comments made during last month’s meeting concerning the signing of contracts by Commissioners, Commissioner Nichols read a statement.  She has requested access to copies of contracts signed for the period from January, 2005 to October, 2008 in accordance with the Kentucky Open Records Act.  The Mayor has arranged for these records to be available on October 27 at 6:30 pm at the Hurstbourne Acres City Hall.  To clarify the issue as to who has the authority to sign contracts for the city, it was recommended by the Commission that a resolution be drafted by the city attorney for review at next month’s meeting.

 

Sanitation Commissioner

Before talking about city sanitation issues, Commissioner Lynch suggested that it would be a good idea for all city commissioners to submit to a drug test to avoid problems such as developed in another Kentucky city.  There was no consensus.  Concerning sanitation, yard waste signs for garbage cans are available again; there were no ‘misses’ last month, and new recycle bins and garbage cans were delivered as needed.

 

NEW BUSINESS

Meet & Greet the Candidates

Mayor Fore confirmed that on October 26, 2008 at 2:00 pm there will be a 1 hour ‘meet and greet’ the candidates, who choose to participate, running for city commissioner.  Each candidate will be given 4 minutes to present their positions and reasons for being considered for city commissioner.

 

Municipal Road Aid Funds

Mayor Fore confirmed that the city secured $21,000 from the Fund which were used for the recent resurfacing of city streets.

 

Miscellaneous

After a recommendation was made by Commissioner Lynch to have the newsletter published prior to November 2 to include information about the ‘Meet & Greet’ meeting and the candidates positions, it was discussed and the issue dropped.
