December 2006 Newsletter
The regular meeting of the City Commission was called to order at 7:30 pm on November 16, 2006 at the meeting room of the Hurstbourne Acres City Hall/Police Department, 1940 S. Hurstbourne Parkway, Louisville, Kentucky, with the following persons present:

Commissioner Dunn made a motion to approve as published. The motion was seconded by Commissioner Nichols and passed unopposed.
Treasurer’s Report/Warrants
John Price read the treasurer’s report for October, 2006 and copies were made available for all people in attendance. Commissioner Dunn then made a motion to approve as read, which was seconded by Commissioner Heck. The motion passed without opposition.
The warrants for October, 2006 were then read by John Price, and copies were made available for all people in attendance. Commissioner Dunn made a motion to approve payment of the warrants, which was seconded by Commissioner Hardin and passed without opposition.
Police Chief
Police Chief Redman reported on the following:
From 10/12 to 11/16, there was a total of 330 coverage hours,
-145 public & police contacts,
-12 traffic stops,
-6 calls about suspicious persons,
-2 accidents,
-4 house watch reports,
-2 thefts,
-4 motorist assists,
-1 investigation,
-Dept. of Criminal Justice Training conducted a compliance audit of the Hurstbourne Acres Police Dept which was found to be in compliance,
-Police Officer Danny Cook is now with Metro Police Dispatch and no longer an employee of the City of Hurstbourne Acres,
-Police car now has 3,847 miles,
-Check received from the Governor’s Office of Local Development in the amount of $662 representing our city’s grant award for the Kentucky Body Armor Program,
-As a result of losing a police officer, Police Chief Redman’s hours of coverage were discussed.
Attorney’s Report
In Stephen Emery’s absence, Mayor Fore advised that a response had been received to a letter sent to a resident in the city by the attorney’s office, concerning the usage of a single-family dwelling. An affidavit was provided, signed by the resident, indicating the dwelling was being used appropriately as a single-family residence with a home office in compliance with the zoning regulations.
Election Results
Although Commissioner Heck will not be returning next year, Mayor Fore acknowledged and thanked her for her excellent work over the years.
COMMITTEE REPORTS
Parks
Commissioner Dunn reported that the renovation of the storage shed has been completed. In other news, he noted that there will be one more grass cutting/leaf mulching in the park.
Sanitation
Commissioner Heck advised that there was one missed yard waste pickup for a resident. Rumpke came the next day.
Police
Commissioner Hardin reported again on having a ‘No Right Turn on Red’ sign installed at the corner of Bunsen Way and Hurstbourne Parkway. After discussion, Commissioner Hardin made a motion to have a sign installed, which was seconded by Commissioner Dunn, subject to final recommendation from the city attorney regarding liability. The motion passed with one abstention (Commissioner Nichols).
Roads
Commissioner Nichols reported that the first leaf pickup will be the weekend of 11/18. Commissioner Dunn mentioned that as a result of the grading on Blowing Tree and Wesley by MSD, residents of the houses affected should rake any leaves into the street to prevent damage to the grading from leaf pickup. In other news, the two street signs that were stolen--one at the intersection of Blowing Tree and Wesley and the other at Cardwell Way--have been replaced.
OLD BUSINESS
Taylorhurst
There has been another complaint about the noise from the generator to the MRI trailer. It was once again confirmed that either the trailer would be gone by 12/7/06, or the trailer would be towed.
Answers from LG&E?
After questions by Mayor Fore, Commissioner Nichols advised that she has not heard back from LG&E regarding the painting of the light poles. Commissioner Nichols said that she would call again. It was reported that LG&E did get back with one of the residents who brought up reliability issues at last month’s meeting. In related news, it was mentioned that there are street lights on Hurstbourne Lane that continually blink.
MSD Update
A representative with MSD met with Commissioner Dunn to discuss issues in the park.
Advertising Signs
Mayor Fore received a call from a sign company requesting a permit regarding the new restaurant, El Toro. Commissioner Dunn said that he was concerned about the signs in general being installed along the off-ramp from I-64 to Hurstbourne Parkway. He agreed to check the deed restrictions and present his findings at next month’s meeting. Mayor Fore said that he would contact the sign company for further information regarding size, location, etc.
Pavilion
Commissioner Hardin made a motion to construct the pavilion in the park as previously discussed and designed for the bid of $37,000. The motion was seconded by Commissioner Dunn. The motion failed to pass based on the following roll call: Commissioner Hardin (Yes), Commissioner Dunn (Yes), Commissioner Nichols (No), Commissioner Heck (No), and the deciding vote by Mayor Fore (No). After the motion failed, Commissioner Nichols made a motion to have a referendum vote by residents to be included in the next newsletter. The motion was seconded by Commissioner Heck and passed with one opposed, Commissioner Hardin.
Walking Path
Commissioner Hardin presented plans for a walking path in the city. After the discussion, a $300 grant was authorized for the committee to investigate further.
Miscellaneous
In other news, a resident reported that tree roots from a dead tree, which separated the south side of Wesley from the apartments, along with others, have yet to be removed and a new tree planted, in compliance with the deed restrictions. Mayor Fore said that he would talk with the apartment manager.
There has been no reply from the Fire Chief about the fire lane situation on Hurstbourne Circle.
The emptying of dumpsters by waste management companies in violation of the city ordinance was discussed, and the Police Chief was instructed to cite the violators.
The problem with speeders on Hurstbourne Lane at evening rush hour was brought up by a resident and solutions discussed. Police Chief Redman will adjust his hours to patrol between 4:00 pm and 6:00 pm.
Finally, Commissioner Dunn shared some information from the study about the impact of the development of the Bullitt property on the traffic along Hurstbourne Parkway and our city. After Commissioner Dunn suggested that our attorney track the progress and voice our concern to the appropriate parties by letter, Mayor Fore recommended that Commissioner Dunn write the letter. He will e-mail the final draft to Mayor Fore.
There being no further business or discussion, the regular meeting was adjourned. Immediately afterward, an Executive Session was convened to discuss specific personnel issues under KRS 61.810. After all information was provided and discussed, the Executive Session was adjourned.
