SERIES 2007


AN ORDINANCE RETAINING THE CITY ATTORNEY


WHEREAS the City Commission of the City of Hurstbourne Acres, Kentucky has
determined the necessity for continued retention of an attorney to provide
legal services and advice to the Mayor and City Commission, therefore, BE IT
NOW ORDAINED THAT

SECTION 1. The City of Hurstbourne Acres, Kentucky does hereby retain for a
period of two (2) years as City Attorney JOHN FRITH STEWART, for the period
commencing April 1, 2007 and continuing through March 31, 2009, for a basic
retainer of Two Thousand, Four Hundred Dollars ($ 2400.00) annually, payable
in advance.

The City Attorney or his designee shall attend the meetings of the City
Commission if and when required; prepare brief Ordinances, and draft and
review legal contracts for the City.

Should the City Attorney, or any of his staff, be required to attend more
than one meeting in any calendar month or Court sessions or attend or
provide advice relative to Administrative Hearings, or advise relative to
other legal issues including zoning related matters, preparation of
ordinances or represent the City in potential or actual litigation, he shall
be compensated at the rate of One Hundred Eighty-Five Dollars ($185.00) per
hour during the first year, and Two Hundred Twenty Dollars ($220.00) per
hour beginning on April 1, 2008, and shall be reimbursed for all incurred
expenses. Should the City Attorney be authorized by a resolution of the
City Commission to collect taxes which are more than one year delinquent,
the City Attorney shall receive a fee in an amount equal to one-third (1/3)
of the taxes collected, plus costs advanced.

SECTION 2. This Ordinance is effective immediately and shall be published as
is required by law.
